By accessing or using the YourMountains website located at yourmountains.life (the "Site"), submitting any form, joining any waitlist, or otherwise interacting with any service operated by YourMountains Outdoor Collective ("YourMountains," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms").
If you do not agree to these Terms, please do not use the Site or any of our services. These Terms apply to all visitors, users, survey respondents, waitlist members, and anyone else who accesses or uses our Site or services.
We reserve the right to modify these Terms at any time. Material changes will be reflected in the "Last Updated" date at the top of this page. Continued use of the Site after changes constitutes your acceptance of the revised Terms.
YourMountains is an outdoor lifestyle and community platform currently in pre-launch development. The Site provides information about the platform, collects survey responses to inform product development, operates a Founder's Club waitlist, and provides contact and communication functionality.
No fully functional application services are provided through this website at this time. Features, pricing, and availability are subject to change. YourMountains makes no guarantees about the launch timeline, scope, or final form of the platform.
You must be at least 13 years of age to use the Site. By using the Site you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.
We do not knowingly collect personal information from children under 13. If we become aware that we have collected personal information from a child under 13 without verifiable parental consent, we will take steps to delete that information promptly. If you believe we have inadvertently collected information from a child under 13, please contact us immediately at policy@yourmountains.life.
By submitting your email address through any form on our Site, you agree to receive communications from YourMountains, including but not limited to platform updates, beta launch announcements, Founder's Club news, and other relevant information related to our community and services.
You may unsubscribe at any time by emailing policy@yourmountains.life or using the unsubscribe link in our emails when available.
We retain submitted information for as long as reasonably necessary to fulfill the purposes described in our Privacy Policy, or as required by applicable law.
By completing any survey on our Site, you grant YourMountains Outdoor Collective a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute your survey responses for the purposes of product development, research, marketing, and improving our services.
Survey participation is entirely voluntary. You may decline to answer any question. Submission of a survey does not create any obligation on our part to act on your feedback or to provide any particular product or service.
YourMountains may, at its sole discretion, offer rewards, incentives, promotions, recognition programs, early access benefits, reduced-fee arrangements, priority placement, exclusive status designations, or other benefits to members, partners, survey respondents, or other participants (collectively, "Promotional Benefits").
All Promotional Benefits are subject to availability, modification, or discontinuation at any time with reasonable notice. YourMountains reserves the right to determine eligibility, timing, scope, and terms of any Promotional Benefit at its sole discretion. No Promotional Benefit constitutes a binding contract or guarantee of future value.
By using the Site, you agree not to engage in any of the following prohibited activities:
All content on the Site — including but not limited to text, graphics, logos, icons, images, audio clips, video clips, software, and the overall design and compilation — is the exclusive property of YourMountains Outdoor Collective or its content suppliers and is protected by applicable intellectual property laws including copyright, trademark, and trade secret law.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes only. You may not reproduce, distribute, publicly display, publicly perform, modify, adapt, translate, create derivative works from, or exploit any content on the Site without our express prior written permission.
Any feedback, suggestions, or ideas you submit to us become the property of YourMountains, subject to the terms of §5 where applicable.
The site and all content, services, and features are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
YourMountains does not warrant that: (a) the Site will be uninterrupted or error-free; (b) defects will be corrected; (c) the Site or servers are free of viruses or other harmful components; or (d) the content is accurate, complete, or current.
Any reliance on any information provided on or through the Site is at your sole risk.
The Site may contain links to third-party websites, services, or resources. These links are provided for your convenience only. YourMountains has no control over the content, privacy policies, or practices of third-party sites and assumes no responsibility for them. Your use of any third-party site is subject to the terms and privacy policy of that site.
Current third-party providers include Netlify (hosting and form processing), Google Analytics (site analytics), and Supabase (data storage). In our mobile application, additional providers include Google Gemini AI and Mapbox.
We are not responsible for the availability, accuracy, content, or security of third-party services. We encourage you to review the privacy policies and terms of service of any third-party services you interact with.
Your use of the Site is also governed by our Privacy Policy, available at yourmountains.life/privacy-policy.html, which is incorporated into these Terms by reference. Please review our Privacy Policy carefully — it describes how we collect, use, and protect your personal information.
We use cookies and similar tracking technologies, including Google Analytics, to understand how visitors use our Site and to improve your experience. You may manage your cookie preferences via the consent banner displayed on your first visit to the Site. For more information, see our Privacy Policy.
To the maximum extent permitted by applicable law, in no event shall yourmountains outdoor collective, its officers, directors, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, or system failure, arising out of or in connection with your use of, or inability to use, the site or any content or services obtained through the site, regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if yourmountains has been advised of the possibility of such damages.
In no event shall YourMountains' total liability to you for all claims exceed one hundred U.S. dollars ($100.00).
You agree to defend, indemnify, and hold harmless YourMountains Outdoor Collective and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any claim that content you submitted caused damage to a third party.
YourMountains reserves the right, in its sole discretion, to terminate or restrict your access to the Site and its services at any time, with or without notice, for any reason, including but not limited to violation of these Terms.
All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
YourMountains reserves the right to update or revise these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site after any such changes constitutes your acceptance of the revised Terms. It is your responsibility to check this page periodically for changes.
If you do not agree to the revised Terms, you must stop using the Site immediately and may request deletion of your data by contacting us at policy@yourmountains.life.
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or your use of the Site shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved informally within 30 days, it shall be subject to binding arbitration administered in Colorado, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property or confidential information.
You agree that any claim arising out of or related to these Terms must be brought within one (1) year of the date the cause of action arose.
